Washington: On Friday, the plea from the accused of the 2008 Mumbai terror attack, Tahawwur Hussain Rana, was rejected by the United States Supreme Court Justice Elena Kagan. The accused had sought to delay his extradition to India.
Rana, a Pakistani-Canadian doctor, stated that he would not survive long enough to stand trial in India due to his deteriorating health. He also claimed that he would face torture because of his religion and Pakistani origin. His plea was dismissed days after former U.S. President Donald Trump reaffirmed his return to India.
“Tahawwur Rana will be going back to India, where he will face justice,” Trump had stated last month in a joint press conference with Indian Prime Minister Narendra Modi.
Rana’s Plea: ‘No Review, and Petitioner Will Be Dead’
In his plea, Rana claimed that if extradited, there would be no possibility of legal review in the U.S., and he would likely die due to mistreatment and poor health conditions.
“If a stay is not entered, there will be no review at all, and the U.S. courts will lose jurisdiction, and the petitioner will soon be dead,” Rana stated.
He also cited the Human Rights Watch 2023 World Report, alleging systematic discrimination against religious minorities in India under the BJP-led government. The report claims that Muslims, in particular, face persecution and stigmatisation.
Mumbai 26/11 Terror Attacks
The Mumbai attacks on November 26, 2008, were orchestrated by the Pakistan-based terrorist group Lashkar-e-Taiba. Ten heavily armed terrorists entered India via the sea route. They targeted multiple locations, including Chhatrapati Shivaji Terminus (CST) Railway Station, the Taj Mahal Palace Hotel, and other high-profile areas.
David Coleman Headley, an American terrorist of Pakistani origin, was one of the main conspirators, and Tahawwur Rana is known to be his close associate.
With the Supreme Court rejecting his plea, Rana is now set to be extradited to India, where he will face trial for his role in the deadly attacks that claimed over 170 lives.
